Agreement

Czexcape Adventure Holidays will provide its services, subject to the terms and conditions set out below. Please read all the following information carefully.

1. BOOKINGS

You must be 18 years old to book and travel on holidays with us and take up the offers advertised by us if they are still available. If you are under 18 years old an adult must accompany you on your journey. There may be other restrictions on some offers, but these are explained in the details of those offers. To reserve, contact us directly. We confirm bookings on a first-come basis and recommend early reservations. We will confirm bookings only upon payment received as per the Payment Schedule below. If any detail on the Confirmation Invoice is not correct tell us immediately. If there is an obvious error on the Confirmation Invoice we reserve the right to correct it as soon as we become aware of it. If any of these changes are not acceptable then you will be entitled to a full refund.

Promotional Materials: Czexcape Adventure Holidays cannot be held responsible for factors beyond our control that may alter the components or description of the package. All photographs are purely representational and are not a guarantee that everything will be exactly as depicted at the site or destination upon arrival.

2. PRICE CHANGES

All prices we advertise are accurate at the date published, but we reserve the right to change any of those prices from time to time. Prices can go up or down. We reserve the right to increase the price of your holiday after you have booked but no later than 30 days before the departure date stipulated and will forward an Amendment Invoice reflecting any changes made. For all other arrangements, after a Confirmation Invoice has been sent to you, any increase to your holiday price will be as the result of changes in our costs of supplying your holiday resulting from transportation charges, currency fluctuations and government action. If the increase is more than 10% of the holiday price (calculated as above), then you may cancel your holiday booking within 14 days of the Amendment Invoice date and receive a refund of all monies paid to us except any amendment charges.

3. PAYMENT SCHEDULE

If bookings are made 45 days or less prior to departure, we require full payment immediately. On bookings made more than 45 days prior to departure, a non-refundable deposit of 50% of the package price is required. Full payment is due 45 days prior to departure. We reserve the right to cancel your booking if payment is not received by Czexcape Adventure Holidays within 5 days of the payment's due date.

4. CREDIT CARDS

When using a credit card to confirm a booking, you give your consent to Czexcape Adventure Holidays to utilise your credit card information for payment. All credit card purchases will be charged a service charge.

5. IF YOU CANCEL YOUR BOOKING

If you want to cancel your booking or part of it, the lead name on your booking or must advise us in writing at the address given in the Important Information below. The letter must be signed by the person who made the booking. To cover the cost of processing your cancellation and to compensate us for the risk that we may not be able to resell your travel arrangements, we make a cancellation charge on the scale shown below. The person who made the booking is responsible for paying this charge. The size of the charge depends on when we receive your form or letter the more notice you give, the less we will. In certain cases a 100% cancellation fee applies as soon as the booking is made and the ticket is issued. If you have taken out good travel insurance, you may be able to claim for the cancellation charge. Please check your policy. No refunds or adjustments will be issued for portions of the trip or services not taken or used.

Cancellation charges
These charges are based on how many days before your booked departure we receive your cancellation notice. These charges are a percentage of the total cost of your booking, not including your insurance premium.

These percentages apply to the total price.

Note: If your travel companion(s) cancels and this alters the room requirements of yourself and any remaining travel companions, you and the others still travelling will be required to pay the applicable costs for accommodation booked. Where the standard deposit is increased to secure specific facilities and these are non-refundable in whole or in part, then the scale of charges shown will be calculated based on a % of the cost of all other arrangements and the non-refundable charges will be added to that cancellation charge to give the total charge.

6. IF WE CANCEL YOUR BOOKING

Contract with you may allow us to cancel bookings. Where this occurs, we will ensure that you are promptly notified of any significant changes e.g. routes, but accept no liability for the changes or costs incurred which may result. For all other arrangements we aim to provide your holiday as booked. But if, for example, there are not enough people booked on your holiday, we may cancel it. We reserve the right to cancel your holiday in any circumstances but if we cancel your holiday you can either have a refund or accept a replacement holiday from us of equivalent or closely similar standard and price (if one is available). In either case, we will pay you compensation, using the scale shown (unless we cancel your holiday because of one of the events listed in the 'Important note - events beyond our control') and we will always refund the difference in price if the replacement holiday is of a lower standard and price. We will not cancel your holiday less than eight weeks before you go, unless this is the result of one of the events in the 'Important note - events beyond our control'.

7. IF YOU CHANGE YOUR BOOKING

If you want to change any details of your booking (such as changing your point or date of arrival) or to cancel an optional extra you have booked, we will do our best to help but please note that we usually treat amendments that would lower the basic price of your holiday as a different holiday. We charge an 'Amendment Fee' for each detail of the booking which you change. If you make the change more than 45 days before departure, the fee will be £25 per person. For any changes within 45 days of departure, appropriate cancellation charges will be applied (see below).The price of your new travel arrangements will be based on the prices that apply on the day you ask for the change. These prices may not be the same as when you first booked your travel arrangements. If, within 45 days of departure, you want to change to a different holiday or you wish to change your arrival date to a later date, you will have to pay cancellation charges. Some types of accommodation are priced according to the number of people staying there. If your booking changes because someone in your party cancels, we will recalculate your booking cost based on the new number of people going. If fewer people share the accommodation, then the cost for them may go up. This extra cost is not a cancellation charge. If you are prevented from taking the holiday you have booked, you may transfer your booking to another person, provided you meet the following conditions: You must sign an amendment/cancellation form authorising us to make the transfer; The person to whom you transfer your holiday booking must comply with all the terms of the existing booking; That person must sign a holiday booking form accepting the transfer and the terms of Our Agreement; -That person must show us new evidence of their holiday insurance, as your policy cannot be transferred to another person; We will also charge amendment fees. This will be added to the new Invoice issued to that person; You cannot transfer a holiday booking within 14 days of arrival; and you will remain responsible for the payment of any balance on that new Invoice should that person fail to pay it.

8. IF WE CHANGE YOUR BOOKING DETAILS

We are allowed to change your booking details. Where this occurs, we will ensure that you are promptly notified of any significant changes e.g. routes, but accept no liability for the changes or costs incurred which may result. For all other arrangements, we hope that we will not have to make any change to your holiday but, because our holidays are planned many months in advance, we sometimes do need to make changes. We reserve the right to do this at any time. We will let you know about any important changes when you book. If you have already booked, we will let you know as soon as we can, if there is time before your departure.

Major changes to your holiday
Occasionally, we have to make major changes to the accommodation making up your holiday with us. If we tell you about any of these changes after we have confirmed your holiday booking, you may either: accept the new arrangements offered by us; or accept a replacement holiday from us of equivalent or closely similar standard and price, if one is available; or cancel your holiday with us and receive a full refund of all monies paid. Either way, we will pay you compensation, using the Compensation table shown, unless the change is for reasons beyond our control (see the 'Important Note - events beyond our control') and we will always refund the difference in price if the replacement holiday is of a lower standard and price. Major changes for which we will always pay compensation, using the scale shown, may include the following changes: a change in accommodation to that of a lower category but see also 'Important note events beyond our control'. This standard payment will not affect your statutory or other legal rights. We will only make one payment for each full-fare-paying adult in the holiday booking. Any children not paying the full adult fare will receive 50% of these amounts.

Important note - events beyond our control
Events beyond our control include: war, threat of war, riots, civil disturbances, terrorist activity, industrial disputes, natural and nuclear disasters, fire, epidemics, health risks, technical problems with transport including changes due to rescheduling or cancellation of flights by an airline or alteration of the airline or aircraft type for reasons beyond our control or that of our suppliers; closed or congested airports or ports, hurricanes and other actual or potential severe weather conditions, and any other similar events.

9. WHAT HAPPENS TO HOLIDAY COMPLAINTS

We can usually sort out any complaints you may have. If you have a complaint or concern during the provision of our services or packages, you should advise us immediately so that Czexcape Adventure Holidays has the opportunity to correct or resolve any problem in a prompt and timely manner.

10. OUR RESPONSIBILITY

We will arrange for you to receive the services that make up the holiday that you choose and that we confirm. These services will be provided either directly by us or through independent suppliers contracted by us. If any part of your holiday is not provided as described and this spoils your holiday, we will pay you appropriate compensation (see the 'Important note events beyond our control'). We have taken all reasonable care to make sure that all the services which make up the holidays advertised by us are provided by efficient and reputable businesses. These businesses should follow the local and national laws and regulations of the country where they are provided. However, overseas safety standards are generally lower than in the UK, for example few hotels yet meet EC fire safety recommendations even in Europe. We will not assume responsibility for any claims, losses, damages, costs or expenses arising out of personal injury, accident or death, loss, damage or delay of baggage or other property, or delay, inconvenience, loss of enjoyment, upset, disappointment, distress or frustration, whether physical or mental, resulting from any cause that arises by reason of actions of parties other than Czexcape Adventure Holidays. We suggest that you purchase cancellation or comprehensive insurance.

11. PERSONAL INJURY AND RISK

This section covers injury, illness or death while you are using the holiday services that we have arranged for you. We have no direct control over the way our suppliers provide their services but everyone employed or contracted by us or by our suppliers is expected to carry out their duties properly. You understand that participating in our packages may expose you to various risks. These include the risk of accident or illness, weather, parasitic or infectious disease, unforeseen stressful situations, and injury to person or equipment by humans, wildlife or conveyances such as automobiles, buses, trains, boats, horses, and other vehicles, or by walking or climbing and consequently falling due to slippery or uneven surfaces or unforeseen obstacles. These risks are examples only and are not exhaustive. As a participant, you freely accept and fully assume all such risks, dangers and hazards and the possibility that personal injury, death, property damage and loss may result. We require that you notify Czexcape Adventure Holidays of any pre-existing medical condition.

This section covers damages, injury, illness or death which is not connected with the arrangements made by us. If you or someone on your holiday booking is injured, falls ill or dies while taking part in an activity which is not part of the holiday, or you need to incur unpredictable extra expenses for which we are not liable (see 'Important note events beyond our control') we will try to help if we can. For example, we can help by: providing translation services communicating with authorities and others in foreign resorts recommending foreign lawyers (if necessary) explaining the procedures you should follow telling you of any time limits.

12. YOUR CONTRACT

By asking us to confirm your booking, you are accepting that the terms of this Agreement applies to your booking. You also consent to our processing personal information about you and other members of your party (see Data Protection in Important Information).

13. CONDUCT WHILE TRAVELLING

We reserve the right to refuse to accept you as a customer or continue dealing with you if your behaviour is disruptive or affects other travellers or is threatening or abusive towards our staff on the telephone, in writing or in person. If this occurs overseas then you will become responsible for your own return home and any other members of your group who cannot or will not travel without you. In any of these circumstances no refunds or compensation will be paid to you and we may make a claim against you for any costs and expenses incurred as a result of your behaviour. Criminal proceedings may also be instigated.

14. ACCOMMODATION

The accommodation we arrange for you must only be used by those people named on your Confirmation Invoice (or on any Amendment Invoice issued). You are not allowed to share the accommodation or let anyone else stay there.

You should be aware that different living standards and practices might exist while visiting The Czech Republic. We shall not be held responsible for any loss, damage or injury resulting from different living standards. All hotels undergo routine maintenance and renovation.

15. SPECIAL REQUESTS

For any special requests consult when you confirm your holiday booking. We shall always do our best to meet your requirements, but no guarantee is given as this does not form part of our holiday contract with you, irrespective, of the fact that details of the request may be found on your confirmation invoice. If, however, your request is essential to your holiday arrangements, please make this known at the time of booking in order that we can ascertain whether this is possible with our supplier. While we attempt to accommodate any special requests, Czexcape Adventure Holidays cannot be held responsible if such requests cannot be fulfilled.

16. CUSTOMS AND IMMIGRATION/ DOCUMENTATION

Customs and/or immigration officials can at their discretion deny a person entry into the Czech Republic. A previous criminal record could be the basis for denied entry. Czexcape Adventure Holidays cannot be held responsible for denied entry under any circumstances, and no refunds will be issued.

It is your responsibility to obtain, at your own expense, all documentation required by Czech Customs. Prior to departure, you should determine the documentation required. If you do not possess the documentation required, the carrier reserves the right to refuse passage. In such circumstances, no refunds will be issued by Czexcape Adventure Holidays.

17. COPYRIGHT POLICY

The copyright in this website belongs to Czexcape Adventure Holidays. All intellectual property rights are reserved. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell any information obtained from this website. You may only download to your own personal computer for viewing purposes and print out pages from this website for your own personal use.

HOLIDAY TRAVEL INSURANCE
It is a condition of booking that you take travel insurance policy. No liability will be accepted for the consequences of your travelling without adequate travel insurance.

Travel insurance is always important whatever type of holiday you take - it provides you with peace of mind in the event of the unexpected. On activity holidays where you are taking part in a range of outdoor sports, insurance is essential. We plan all of our activities with the utmost care - all of our guides have undergone rigorous training and monitoring and all the centres we use are thoroughly checked in line with procedures designed for us by our independent risk assessment consultants. All equipment used in any of the activities we organise is of a high standard and undergoes regular checks. This gives you complete peace of mind and leaves you free to get on with the important business of enjoying your holiday. Therefore without valid proof of travel insurance you will not be allowed to go on any activities. Ensure you have taken out adequate travel insurance. You may be tempted to opt for a cheaper premium but please double check that it covers the activities you intend to partake in.

ACCURACY OF WEBSITE
All information on the website is to the best of our knowledge and belief correct at the time of publication. However, we reserve the right to make changes to information contained within our website and will advise you of these changes at point of booking or when they are known to us. This advice will be limited to that which is fundamental to the contract or which we believe may affect the enjoyment of your holiday. We are sure you will understand that at times certain advertised facilities may not be in operation and we may have no information or prior warning of such matters. Many pictures are included for their attractiveness and general relevance; those with specific notation refer to relevant features.

EARLY AND LATE SEASON
Due to poor volume of support and unsettled weather conditions, particularly in early and late season, it could be a case that advertised activities such as guided hikes or bike rides and other activities may not be available. Similarly, some advertised resort and hotel facilities such as swimming pools, sporting activities and facilities, leisure facilities, restaurants, shops, etc. may not be in operation or open.

LOCAL DEVELOPMENT AND LOCAL EVENTS
The noise and inconvenience of building work inevitably seems worse on holiday. While we have no control over building works, we will do our best to tell you about any specific work going on near your accommodation, if there is time before you go on holiday.

EVENING EVENTS AND RECOMMENDED VENUES
The advertised events are dependant upon achieving a minimum number of participants and, therefore, some events may not always be available due to insufficient demand or, in some cases, adverse weather conditions. All mentioned restaurants and other venues featured on this website which are not owned by Czexcape Adventure Holidays are not under our direct control and have not been inspected by us. Therefore, any recommendation is merely an indication that these facilities have proved popular and are worthy of mention and not a personal recommendation by Czexcape Adventure Holidays.

YOUR ACCOMMODATION
Properties on this website have been carefully chosen and are considered to offer suitable accommodation for the cost shown. To avoid confusion, many properties featured are described as hotels as, in our view, terms such as Pension, B&B and the like do not always reflect the quality of the properties and are usually an official grading for tax purposes. Baths may not always be full size and showers may not always have a shower tray or curtain. Soap is not always provided in rooms. Children may not always be allowed in hotel bars, even when accompanied by their parents. In some cases swimming trunks not shorts and swimming hats may be compulsory.

FOOD
Vegetarian/Special Diets: customers requesting such meals may find choice limited in some hotels. Similarly, it may be difficult for some hotels to cater for the needs of customers with strict special diets. If you have any special dietary requirements it is important that you request these at the time of booking.

HOTELS
Our accommodation ranges from larger properties to smaller traditional family hotels. Due to this wide range it is difficult to grade them on a like for like basis and, in addition to the facilities available, location and general standard.

OTHER GUESTS
Hotels/Camp Sites: We do not have details of other bookings taken by hoteliers/accommodation owners and are unable, therefore, to provide any information in this respect. Neither are we advised of any conference/convention bookings, schools or wedding groups. Whilst we will make every effort to ensure to assist wherever possible if any guests' behaviour is considered anti-social or discourteous, you will appreciate that we have no control over the behaviour of any guests. Smoking: If, despite our best efforts, guests smoke in a non-smoking areas, we cannot accept liability for any discomfort.

WATERSPORTS/ACTIVITIES
Important Information: All included tuition described is group based and is available for those who can swim a minimum of 25m. For safety reasons, access may be restricted at times. Professional safety cover is provided by qualified staff in fully equipped safety boats for all canoeing, rafting and kayaking activities. A water sports safety briefing, buoyancy aids and a first aid point are always available. We reserve the right to withdraw water sports if the wind/weather conditions or the competency or behaviour of any guests gives cause for safety concern.

TRANSFERS
Approximate timings: In order to keep prices low we sometimes need to combine transfers to and from the resorts for passengers from several arriving and departing flights. This means you may incur additional waiting time on arrival at the airport and on your return, though we will do our best to keep waiting times to a minimum. Transfer times listed are approximate and can vary due to poor weather, traffic conditions or transfer routes. Please note that some transfers to your resort may not be accompanied by a Czexcape Adventure Holidays representative and may include transferring onto a smaller vehicle to take you into the resort and your accommodation.

VISA AND PASSPORT
It is a customer's responsibility to be in possession of a full 10 year valid passport and any necessary visas.

REPRESENTATION
We will always have at least one guide with you who will give guidance and assistance. Details of an emergency contact number will be provided upon arrival.

EXCURSIONS/ACTIVITIES
By the very nature of Czexcape Adventure Holidays you will be participating in activities that are potentially hazardous, therefore please check the details of your holiday insurance to ensure you are covered beforehand. As with all adventure sports, you partake at your own risk and you may be required to sign a disclaimer prior to some activities. Any excursions or hazardous activity in which you partake locally, such as white water rafting, horse riding etc. are at your own risk and liability may not be covered under the terms of your holiday insurance. Please check the details of your individual policy before participation.

OTHER EXCURSION INFORMATION
Days of operation of excursions are sometimes subject to change which may occasionally mean that it may not be convenient or it may coincide with a weekly transfer day. Also excursions may be cancelled due to poor volume of support, or poor weather conditions. In such circumstances we will always try our best to offer alternatives locally but should this not be possible a full refund of the excursion cost will be paid. Please note that when refunding an "Included" activity we refund the cost to us. Some excursions may involve a fairly lengthy journey for a relatively short time at the destination and we would therefore suggest you make enquiries before booking. On some excursions the commentary may be conducted in several languages and an English speaking guide may not always be available. The size of vehicle used will be dependent upon the number of passengers. In the event of Sterling dropping significantly below our estimated exchange rates, Czexcape Adventure Holidays must reserve the right to increase these costs at any time or to withdraw the excursion. The prices detailed on this website may be higher or lower than resort prices due to exchange rates or special offers available locally at the time. However, should this be the case no refunds or extra costs are due on items pre-booked. Please note that no refunds can be made except in the case of early cancellation by travellers or Czexcape Adventure Holidays. Children's minimum ages have been given for guidance. Some suppliers actually use a child's height/weight to determine whether they can partake in the activity. The final decision on whether to accept a child rests with the supplier. Children under 16 must be accompanied by a parent/guardian when joining our tours

WHAT IS/IS NOT INCLUDED IN YOUR HOLIDAY PRICE

Deposit
When you make a booking you must pay the deposit amount.

PRICES DO NOT INCLUDE
Meals and accommodation en route (except where specified), flights, travel insurance (which you must have, see Insurance section). Carriage of bikes or boats on charter flights. Any services provided locally that are advertised as being available at the booked resort or accommodation, but not described as free of charge e.g. extra activities. Any local gratuities, taxes charged by hotels, credit card handling fees, Visa fees.

ADMINISTRATION CHARGE
We reserve the right to levy an administration charge in certain circumstances to cover any additional costs incurred by us, such as contacting suppliers to check availability or special requests, returning lost property, special ticket dispatch, extra administration relating to late bookings within 7 days of departure etc.

WHILST ON HOLIDAY
If you want to make changes to the booked arrangements, for example upgrading your accommodation, changing activities or reducing your holiday duration, changes will be subject to availability. Any extra costs or cancellation charges must be paid by you locally. All changes must be arranged with us in writing. You are not allowed to share the accommodation or let anyone else stay there. You are responsible for any damage caused to your holiday accommodation during your stay, except by unknown third parties and any justifiable charges made by the owner/hotel manager in this respect must be paid by you locally.

HEALTH MATTERS
Customers are reminded that they should check with their own doctor for advice on medical requirements of the host countries. Please bear in mind that when you arrive on our holiday you should allow a little time to acclimatise physically, drink plenty of water, reduce alcohol intake and ensure that appropriate winter clothing is taken. Special Needs, Disabled and Elderly Customers: We are happy to advise and assist elderly, special needs or disabled customers to choose a holiday. However, some of the properties featured in this brochure may lack even the simplest facilities such as ramps for wheelchairs and lifts etc. Therefore, we must be provided with full written details of any disability or special requirements before booking to ascertain whether the holiday of your choice is suitable. Failure to advise us of any medical condition prior to booking may result in the chosen holiday being unsuitable and may cause inconvenience and distress to all customers on that holiday. In that case we reserve the right to terminate your holiday arrangements with us, for which we would not be liable to make alternative arrangements or to make refunds or pay compensation.


KNOW BEFORE YOU GO

Useful Information
Because we aim to organise activities for both beginners as well as the more experienced the amount of kit you need to bring with you is limited. In all cases you are able to bring and use your own equipment, as long as it matches relevant safety standards. If this is your first holiday with us you may have a number of questions about how things work. If your accommodation includes a free activity, please try and make your choice at least two weeks before you travel. There are times, particularly during peak season when your first choice may not be available.

Please pre-book your choice of other activities at least two weeks prior to departure, taking care to note the minimum ages for children.

When packing, please take in to account that during our trip you may be staying in the mountains. Summer days in the Czech Republic are often hot but some nights can be a bit cool so please bring a jumper or fleece for the evenings. Good sunscreen is essential.

For most of our water-based sports you will need a swimsuit (to wear under your wetsuit) and, for canoeing, rafting and kayaking, an old pair of trainers is advisable.

If you are going hiking then please bring a small day pack with you in which you can store a jumper or waterproof windbreaker in case the weather turns cooler. You should also wear a sturdy pair of walking boots to protect your ankles.

Experienced mountain bikers may decide to bring their own mountain bike. Please check with the airline you are traveling with will transport your bike and what the additional cost, if any, will be. You must also notify us at least two weeks prior to your departure if you will be bringing your own bike so that we can make arrangements to transfer it from the airport to your accommodation on your arrival.

We will provide you with all the kit you need. We have our own fleet of Giant mountain bikes. If you bring children with you under age of 16 or of a small built and require children's bikes please ensure that you note that when booking your holiday as these will have to be hired out.

Please be aware that when the bikes are in your care you will be responsible for their safe return to the hotel/camp site each day. You will be responsible for any loss or damage to the bikes. Please check your insurance. You may be asked to pay a refundable deposit.

The groups which our representatives take out hiking and biking are limited in size.
